General terms and conditions (GTC) for renting the NAIPO massage chair

Scope
This contract applies to all rental agreements concluded between the landlord and the tenant regarding the massage chair. If there are any questions or uncertainties regarding this contract, the tenant can contact the landlord.

Name of the landlord
Mustbuy GmbH, Eiffestrasse 68, 20537 Hamburg

Registration and customer data
To conclude a rental agreement, the tenant must be registered. The tenant undertakes to provide truthful information when registering and to immediately notify the landlord of any changes to his data.

Contract
The subject of this contract is the rental of the massage chair. The massage chair can be both new and used. Purchasing the massage chair is possible by arrangement. A purchase option is possible at any time. Only the difference is calculated.

Terms of payment
50% of the rental amount is due immediately after signing the contract. The remaining 50% is due within 7 days after the end of the agreed rental period.

Refund policy
The renter has the right to return the massage chair within 30 days of delivery. In order to exercise this right, the renter must inform the lessor and return the massage chair in perfect condition, including pallet and packaging. In this case, the renter must pay all costs of the return. If the return takes place within 30 days, the renter will be credited with the amount for the remaining term of the agreed rental period.

Shipping costs
There is a charge of EUR 79,99 for shipping the massage chair to the curb, which must be borne by the renter. After the end of the rental period, the renter also bears the return costs of EUR 79,99. However, if the renter decides to buy the massage chair, there are no return costs. Any shipping costs are waived if the renter picks up the massage chair from a renter's warehouse.

Start of rental, rental period and termination
The rental period begins when the massage chair is handed over to the tenant. The minimum rental period is 3 months. A shorter rental period is not possible. The contract can be terminated both ordinary and extraordinary. Details of the notice period are specified in the contract.

Storage of packaging and pallet The lessee is obliged to keep the packaging including the pallet for the entire duration of the rental period. A deviation from this clause is only permitted with the express written consent of the landlord.

Technical support
In the event of technical problems with the massage chair, Mustbuy GmbH customer service is responsible at support@mustbuy.eu.

Maintenance and care
For questions about regular maintenance and care of the massage chair, as well as special cleaning and care instructions, please contact support@mustbuy.eu.

Spare Parts
If parts of the massage chair need to be replaced, the cost coverage depends on whether the damage was caused intentionally or not.

Extension of the rental period
An extension of the rental period is possible. To do this, the tenant must contact support@mustbuy.eu.

Transport
The transport of the massage chair is carried out by the forwarding partner of Mustbuy GmbH. A free collection by the tenant at the beginning of the rental period is also possible.

Storage of packaging and pallet The lessee is obliged to keep the packaging including the pallet for the entire duration of the rental period. A deviation from this clause is only permitted with the express written consent of the landlord.

theft and accident
The lessor bears no costs in the event of an accident. In the event of theft, the renter must pay the RRP purchase price of the massage chair to the lessor within 30 days.

Late Payment Fees
If the tenant does not pay within 30 days, the massage chair must be returned to the landlord immediately.

condition upon return
Mustbuy GmbH evaluates the condition of the massage chair when it is returned. Normal signs of use are permitted. All functions must be usable without restrictions. Modifications of any kind are not allowed.

penalties
If the massage chair is not returned by the end of the term, penalty costs of EUR 10 will be agreed for each additional day. These costs will be billed separately to the tenant as soon as the massage chair has returned to the landlord.

Liability
No liability is assumed for injuries of any kind or for catastrophic damage.

cleaning fees
There are no additional charges if the massage chair is not returned in a clean condition.

Jurisdiction
The place of jurisdiction in the event of disputes is Hamburg.

Availability of spare parts
We will provide a replacement as soon as possible. Damage must be reported immediately to support@mustbuy.eu. Sufficient image and video material must be made available for this purpose.

Privacy notice
Mustbuy GmbH undertakes to protect the tenant's personal data in accordance with applicable data protection laws. All personal data will be treated confidentially and will not be passed on to third parties unless this is necessary for the execution of the contract.

Pets
Households with animals are allowed. However, these must not damage the NAIPO massage chair.

Cross-border use
The massage chair may not be taken abroad.

Energy consumption
The tenant bears the costs for the electricity consumption of the massage chair.

Emergencies
If the massage chair suddenly stops working or shows a defect, the renter should immediately contact Mustbuy GmbH customer support at support@mustbuy.eu.

Liability
The tenant is liable for all damage to the massage chair that occurs during the rental period through improper handling, intent or gross negligence. The lessor is not liable for damage caused to the lessee by using the massage chair, unless this is due to intent or gross negligence on the part of the lessor.

Final Provisions
Changes or additions to these terms and conditions must be made in writing. If individual provisions of these General Terms and Conditions are or become ineffective or unenforceable, the validity of the remaining provisions remains unaffected.
